Quality Management Provisions for BeiDou Civil Service
Article 1 These provisions are formulated to further standardize the Civil Service of BeiDouNavigation Satellite System (hereinafter referred to as BeiDou Civil Service, BDCS), strengthen the management of BDCS units qualification, ensure the safety of the BeiDou Satellite Navigation System, and promote the healthy development of the BeiDou Satellite Navigation Industry.
Article 2 Provisions written in this paper is the basis for the management of.
BDCS here is identified as the BeiDou Navigation branch level service and BeiDou Navigation terminal service that are provided to the society.
BeiDou Navigation branch level service refers to BeiDou Satellite Navigation's branch service for positioning, time service, position report and short message service and to carry out approved value-added services and develop application projects.
BeiDou Navigation terminal service refers to the production activities of BeiDou Satellite Navigation chip, board, module and the complete machine etc..
BeiDou Navigation Civil Service Qualification Management refers to the set of activities censoring the qualification of the units applying for using the BDCS and supervising the maintenance of the certified units.
Article 3 The management of BDCS should abide by the principles of giving overall consideration to the whole management, management according to law, fair and just and with dynamic adjustment.
Article 4China National Administration of GNSS and Applications (hereinafter referred to as CNAGA) is responsible for the organization and implementation of the management of BDCS.
Article 5 Units applying for using BDCS shall meet the following basic conditions：
1. Legal person qualification consistent to the service application;
2. Professional and technical capability consistent to the service application;
3. Quality assurance capability consistent to the service application;
4. Financial capital condition consistent to the service application;
5. Good business reputation;
6. Confidentiality qualification consistent to the service application.
Specific conditions required for applying branch service and terminal service of BDCS please see Units Qualification Standards of BeiDou Navigation Civil Service.
Article 6 Units applying for BDCS should submit the Application Form for BeiDou Navigation Civil Service Qualification Examination together with related certification materials.
Article 7CNAGA will examine the integrity of the application materials and make an acceptance decision within 10 days to those who are eligible.
Those whose application materials are incomplete or inconsistent with the statutory form should be informed within 10 days with all the information that should supplement and correct all at once.
Applicant units who fail to be accepted should be informed in written form and given the reasons.
Article 8 After CNAGA receives the application, a review team will be set up for examination.
Article 9 The review team should adopt the examination method that combines documents review and field review.
Documents review refers to the activity of examining related materials submitted by the applicant.
Field review refers to the activity of a field visit to the applicant unit for close examination.
The review team is responsible for the examination results and adopts a team leader responsibility system.
Article 10CNAGA examines the results from the review team and gives handling advice.
For applicants who consent to register, CNAGA should issue a Certificate to the units within 5 working days from the date of approval.
For those who disagree to register, CNAGA should notify the units in written form.
Article 11 The validity period of the Certificate is 4 years.
It includes: Certificate number, legal person's name, registered address, business address, service category, business scope, certification department, the date of issuance (renewal), validity period, annual inspection records.
Certificates are uniformly printed by CNAGA.
Article 12 Units that have obtained BDCS qualification should conduct business within the business scope stated in the Certificate and should label the Certificate number in the contract and in the product certificate.
Those who lose the Certificate should report relevant information to CNAGA and apply for a replacement.
Article 13CNAGA should list the name of the units who have obtained a Certificate in the Directory and release regularly to the society and relevant departments.
Article 14 For units who have obtained the BDCS qualification and whose Certificate is within the valid period, if any change happens to their legal name, registered address or business address, they should submit, within 10 working days from the date of the change, BeiDou Navigation Civil Service Qualification Change Request Form and other proof materials to CNAGA.
Upon receiving the change application, CNAGA should start reviewing the BeiDou Navigation Civil Service Qualification Change Request Form and other proof materials and should, within 15 working days from the date of receiving the application, handle the change procedures for those satisfying the change conditions and renew the Certificate.
For those who apply for reducing service items, CNAGA should implement according to the Certificate change requirements.
Article 15 For units who have obtained the BDCS qualification and whose Certificate is within the valid period, if they apply to add service items, they should put forward an examination application for adding service items and submit Application Form for BeiDou Navigation Civil Service Qualification Examination and other proof materials.
CNAGA will establish a review team, focusing on examination of the contents involved in the added service items, and give review conclusion.
Approval of the increase of service items, CNAGA will renew the Certificate for the units.
Article 16 For units who have obtained BDCS qualification, if intended to apply for the continuation of their qualification, should present the examination application for qualification continuance 3 months prior to the expiration of the Certificate's validity period, and should submit Application Form for BeiDou Navigation Civil Service Qualification Examination and other proof materials.
CNAGA will establish a review team, focusing on examination of the units' qualification changes during certified period, and give review conclusion.
Approval of qualification continuance, CNAGA will renew the Certificate for the units.
Examination of service item increment and examination of qualification continuance can be carried out in combination.
Article 17CNAGA carries out the management of the certified units by building archives for these units, handling major matters reported by these units, organizing annual supervision and inspection, and carrying out daily supervision etc.
For the problems found during supervision management, CNAGA will assert a claim of rectification deadline to the certified units.
Article 18 Qualification will be cancelled if the certified BDCS unit is under any one of the following conditions:
- Unsolicited application for cancellation;
2. No application for renewal of qualification when its qualification validity expires;
3. Results of qualification continuance examination as unqualified;
4. Occurrence of information leakage;
5. Lease, lending, transfer or alteration of the Certificate
6. Provide BeiDou authorization service to any individual or organization outside the country (territory) without permission from CNAGA;
7. Not submit correlated agreements of authorized user identity information, custom location, position report or short message service;
8. Lend, sell or transfer the possession of registered user ID card without approval of CNAGA;
9. Relevant qualifications used in registration been revoked or penalized by the national executive branch;
10. Not able to complete rectification within the prescribed time limit;
11. Other situations that should face legal cancellation.
Upon finding the need to cancel a certified unit, CNAGA should withdraw the Certificate, cancel its qualification on the Directory, and make a cancellation announcement to the public within 5 working days from the date of the cancellation.
CNAGA shall not receive the secondary application from the unit that has been once cancelled qualification.
Article 19CNAGA is responsible for receiving enquiry, query and accusation about BDCS.
For enquiries and queries, CNAGA should reply within 5 working days.
For accusations, CNAGA should reply within 10 working days. Time of field verification and rectification is not included.
Article 20CNAGA is responsible for keeping the business secrets for the applicant units in its management.
Article 21 Qualification examination of BDCS is free of charge.
Article 22 For units applying for branch service of BDCS, if they possess the basic conditions but has not completed the service platform construction, they can propose a test application for qualification examination.
If the test qualification examination is qualified, CNAGA will inform and grant these applicant units with a test qualification of the BeiDou Navigation Branch Civil Service.
Upon completion of service platform construction and with the number of users reaching the requirements, these units should resubmit the qualification examination application.
CNAGA will, referring to the management methods for the certified units, conduct supervision and management to the units that have received the test qualification of the BeiDou Navigation Branch Civil Service.
Article 23 This set of provisions is to put into force from August XX, 2014. The BeiDou Navigation Civil Service Qualification Temporary Provisions is to be abolished at the same time.
